Premier League side Everton were found to have breached Profit and Sustainability Rules (PSR) back in 2022. They managed to survive that season, finishing four points above the relegation zone.

Years later, some Premier League clubs, including Leeds United and Burnley decided to take on the Toffees in court.

Their case was that Everton breaching PSR, gave them an unfair advantage which caused both teams to miss out on a place in the top flight. They had an initial 10-point deduction, which was reduced to six points after an appeal.

Burnley demanded £50 million from the Merseyside club, while Leeds decided to settle their case down the line.

The Whites believed that they did not have a strong enough case to take to court. Both sides managed to settle the issue out of court, with no full picture of the financial details involved.

Everton ordered to pay Burnley £35m in major case update

While Leeds settled, Burnley went ahead with their case. And it was announced this week that the Toffees had been ordered to pay the Clarets £35 million. The verdict can still be appealed by the Merseyside club.

Everton released a statement, saying that the club were ‘surprised’ by the decision.

“Everton Football Club is surprised and angered by the decision of a Premier League Independent Disciplinary Commission to order a compensation payment to Burnley Football Club in relation to Everton’s PSR breach in June 2022,”

“Everton has appealed the decision and is clear in its belief the ruling is fundamentally flawed in both law and fact.

“The club does not recognise the findings of the panel in determining Burnley’s relegation from the Premier League in May 2022 was caused by a sporting advantage gained by Everton due to a breach of Profit & Sustainability Rules, for which a substantive sporting sanction has already been received.”

The full details reveal that the compensation order was £26m, plus interest of £9.1m.

Burnley reportedly sought £51.7m in recompense but Everton disputed the calculation.

New Premier League rules could prevent more drama

Last month, Mark Kleinman of Sky News revealed that the Premier League could potentially allow clubs to negotiate settlements over financial breaches.

This would prevent situations like this from happening again in the future.

Clubs would be sanctioned and punished swiftly when a breach occurs; something clubs are said to be in favour of. The rules are yet to be formalized, and will be voted on at the Premier League’s annual meeting this month.

Going forward, the 49ers and Leeds United need to be very careful with their finances to avoid any of these incidents.
